As it stands now, the redevelopment plan for the site would allow residential development at the site as long as a hotel was also built there.

The township has since terminated its redevelopment agreement with M&M, with the matter currently being litigated in Superior Court.

A companion ordinance would remove the property from the mixed-use overlay zone, where residential development is allowed beside commercial space.

“Since we don’t want to have residential there, we’re going to get rid of the mixed use zone so there’s no misunderstanding that we don’t want residential development at the Foodtown property,” said Mayor John Ducey.

Both ordinances passed unanimously on first reading last month. A public hearing will be held before the vote Tuesday night to formally enact the ordinance.

The council meeting begins at 7 p.m. at the township municipal complex on Chambers Bridge Road.

The Brick Township council is set to take a final vote Tuesday night on a measure revising the redevelopment plan to prohibit residential development at the former Foodtown property on Route 70.
