Roe, 23, of Point Pleasant, who was placed under arrest for\u00a0driving while intoxicated and transported to Brick Police Department, Della Fave said.<\/p>\n<div id=\"attachment_6099\" style=\"width: 250px\" class=\"wp-caption alignright\"><a href=\"https:\/\/www.shorebeat.com\/brick\/wp-content\/uploads\/2015\/09\/smalling.jpg\" data-rel=\"lightbox-image-1\" data-rl_title=\"\" data-rl_caption=\"\" title=\"\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-6099\" class=\"size-thumbnail wp-image-6099\" src=\"https:\/\/www.shorebeat.com\/brick\/wp-content\/uploads\/2015\/09\/smalling-240x180.jpg\" alt=\"Patrick Smalling (Photo: Ocean County Jail)\" width=\"240\" height=\"180\" \/><\/a><p id=\"caption-attachment-6099\" class=\"wp-caption-text\">Patrick Smalling (Photo: Ocean County Jail)<\/p><\/div>\n<p>Patrick Smalling, 25, of Point Pleasant, a passenger, was walking on scene with no complaints of pain, attempted to leave on foot, and was subsequently\u00a0placed under arrest for obstructing the investigation and transported to Brick Police Department for processing, said Della Fave. Another Passenger, Brandon Nikola, 25, of Point Pleasant, had no complaints of pain and was transported home by officers from the Point Pleasant Borough police department.<\/p>\n<p>Nikola confirmed Roe was driving, said Della Fave.<\/p>\n<p>A third passenger, Michael Guerrero, 25, of Point Pleasant, was found to have been partially ejected from the vehicle and was transported to Jersey University Medical Center\u2019s trauma wing with serious injuries.<\/p>\n<p>Roe was additionally charged with third degree assault by auto with bail set at $15,000 cash in Brick municipal court. Smalling had bail set at $1,000 and\u00a0also had a $500 warrant out of\u00a0Point Pleasant. Both Roe and Smalling were\u00a0transported to Ocean County Jail in default of bail. Roe was also charged with 6 motor vehicle violations, including the DWI charge.<\/p>\n<p>The Brick Police Traffic Safety Unit, Ocean County Prosecutor\u2019s Office Vehicle Homicide Unit, and Ocean County Sheriff\u2019s CSI conducted the crash investigation. Tire marks indicated that the red 2003 Ford Explorer was traveling in a southerly direction on\u00a0Burnt Tavern Road approaching\u00a0Mill Pond Road when, for an unknown\u00a0reason, it veered into the shoulder and began to cross lanes into the northbound side of the roadway, Della Fave said.<\/p>\n<p>\u201cThe vehicle entered into a critical speed yaw, hit\u00a0the\u00a0unimproved shoulder\u00a0and rolled onto its roof\u00a0into the wooded area where it came to final rest,\u201d he said.<\/p>\n<div class=\"fcbkbttn_buttons_block\" id=\"fcbkbttn_left\"><div class=\"fb-share-button fcbkbttn_large_button \" data-href=\"https:\/\/shorebeat.com\/brick\/2015\/09\/police-1-injured-in-dwi-crash-on-burnt-tavern-road-passenger-tried-to-flee-with-case-of-beer\/\" data-type=\"button_count\" data-size=\"large\"><\/div><\/div>","protected":false},"excerpt":{"rendered":"<p>An SUV being driven by a suspected drunk driver from Point Pleasant veered off Burnt Tavern Road just after 1 a.m. Saturday morning, seriously injuring one passenger, authorities said.
