Coronato announced Friday that his office will appeal a judge\u2019s decision to allow Lorraine Morgan, the Brick school district\u2019s former\u00a0academic officer, acceptance into a diversionary program that allows her to avoid jail time on misconduct charges.<\/p>\n<p class=\"p1\"><span class=\"s1\">Morgan\u00a0was indicted in September 2015 on a charge of third degree official misconduct for her role in allegedly approving payment for unnecessary in-home counseling services for Superintendent Walter Uszenski\u2019s\u00a0grandson.\u00a0<\/span><span class=\"s1\">Had she been\u00a0convicted of that offense, Morgan would have faced a\u00a0mandatory period of incarceration which requires at least 2 years of parole ineligibility, said Al Della Fave, spokesman for the prosecutor\u2019s office.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">That pretrial intervention program\u00a0diversion for certain offenders, which if successfully completed, allows the individual to avoid prosecution and a criminal conviction.<span class=\"Apple-converted-space\">\u00a0 Prosecutors<\/span>\u00a0objected to Morgan\u2019s entry into the program because her charge is \u201cbased on a violation of the public trust,\u201d Della Fave said, in that she is alleged to have abused her public position to confer an illegal benefit upon the superintendent\u2019s grandson.<span class=\"Apple-converted-space\">\u00a0<\/span>Superior Court Judge Patricia Roe allowed Morgan to enter the program over the state\u2019s objection on March 17.<span class=\"Apple-converted-space\">\u00a0 <\/span>The State asked Roe to reconsider that decision, however, on May 3, Roe affirmed her decision to allow Morgan into the Pretrial Intervention Program.<\/span><\/p>\n<p class=\"p1\">The case will now go to the state appellate division.<\/p>\n<p class=\"p1\"><span class=\"s1\">Morgan\u2019s husband, Andrew Morgan, the former Interim Director of Special Services, was also indicted alongside\u00a0Uszenski and his\u00a0daughter, Jacqueline Halsey, on official misconduct, theft and related charges in connection with an alleged scheme to provide the superintendent\u2019s grandson with free daycare and transportation at public expense. Morgan is also accused of concealing a past drug-related conviction in the 1980s when he was charged following an <a href=\"https:\/\/www.shorebeat.com\/brick\/2015\/06\/state-ex-brick-school-administrator-with-criminal-record-granted-waiver-in-97\/\">undercover sting in New York City<\/a>.<\/span><\/p>\n<p class=\"p1\">Uszenski is petitioning the court to <a href=\"https:\/\/www.shorebeat.com\/brick\/2016\/04\/suspended-brick-schools-super-seeking-to-quash-indictment-state-appealing-sentence-of-co-defendant\/\">quash his indictment<\/a>.
