According to legal bills obtained by Shorebeat in a separate request filed under the state\u2019s Open Public Records Act, the district was charged by board attorney Nicholas C. Montenegro for his time researching and creating the documents.<\/p>\n<p>Requests for comment on the matter sent to Edwards and Interim Superintendent Thomas Gialanella went unanswered.<\/p>\n<p>Potential termination charges against Uszenski were first discussed at the school board\u2019s reorganization meeting in January, when newly-elected board member Victoria Pakala made a motion instructing Montenegro, who was appointed attorney the same night, to report back to the board at its next regularly scheduled meeting\u00a0\u201coptions regarding termination of his existing contract,\u201d <a href=\"https:\/\/www.shorebeat.com\/brick\/wp-content\/uploads\/2016\/07\/grc_complaint.pdf\">meeting minutes state<\/a>.<\/p>\n<p>The matter was never discussed at a future meeting, but legal bills show numerous instances of Montenegro researching and drafting the termination documents. On Feb. 1, Montenegro charged the district $290 after he \u201cdrafted statement of initial termination charges 1-7.\u201d Earlier, on\u00a0Jan. 14, Montenegro charged the district $391.50 for \u201clegal research\/analysis of legal issues related to pending charges \u2013 filing of termination charges.\u201d<\/p>\n<p>Two days after the draft was apparently authored, on Feb. 3, the district was charged $159.50 after the attorney \u201creviewed, revised and finalized draft of tenure charges.\u201d The entry included work that included a \u201ccover letter for filing, telephone call to prsecutor\u2019s office.\u201d On Feb. 9, the district was charged $87 for, as stated in the invoice, \u201cRevised and finalized draft of charges for review\/discussion with interim superintendent, review of <a href=\"http:\/\/mms.brickschools.org\/Policies\/tabid\/134\/FileId\/469481\/Default.aspx\">policy 5118<\/a>, exhibit attachment.\u201d<\/p>\n<p>Though Uszenski\u2019s full name does not appear on the legal invoices, his initials are present next to each entry. <a href=\"http:\/\/mms.brickschools.org\/Policies\/tabid\/134\/FileId\/469481\/Default.aspx\">Policy 5118<\/a>, which Montenegro researched, covers \u201cnonresident students.\u201d<\/p>\n<p>Uszenski is charged with <a href=\"https:\/\/www.shorebeat.com\/brick\/2015\/09\/uszenski-suspended-without-pay-brick-boe-informed-on-future-options\/\">official misconduct and theft<\/a> for allegedly providing educational services to his grandchild that the child was not qualified to receive. His daughter, Jacqueline Halsey, the child\u2019s mother, was also charged, along with Andrew and Lorraine Morgan, two administrators in the district. All have been <a href=\"https:\/\/www.shorebeat.com\/brick\/2015\/09\/former-brick-superintendent-and-daughter-two-former-school-officials-indicted\/\">indicted<\/a>, though Lorraine Morgan was permitted into a diversionary program under which the charges would eventually be dismissed. The state is appealing her admission into the program.<\/p>\n<p>\u201cA document outlining termination charges is of vital importance to the public interest,\u201d said Daniel Nee, editor and publisher of Shorebeat. \u201cIt is a document for which the taxpayers paid, and a document that has the potential to be key in future legal matters concerning the Uszenski case.\u201d<\/p>\n<p>In the case that Uszenski is acquitted of the charges \u2013 or if they were to be dropped \u2013 the district would likely be responsible for paying Uszenski\u2019s back salary over the time he has been suspended without pay.
