The owner of a vacant parcel of land along Route 35 North in Ortley Beach has proposed developing the property with a mixed-use complex consisting of a 3.5-story building.
An application before the Toms River Township planning board by the owners of the parcel at 26 Seventh Avenue – located at the northeast corner of Route 35 North and Seventh Avenue – seeks approval to allow for the construction of a 3.5 story mixed use building with commercial space on the ground floor and two residential dwellings on the upper floors. The lot, across the street from a commercial building that houses Fumosa Brothers Bakery and several other businesses, is currently vacant land. The property is owned by the principals of Dakan Homes, a construction company based in Seaside Heights.
Several variances are required before the project can commence, including a side yard setback for ground mechanicals of 6.1-feet where 10-feet is required; a solid waste storage setback of 6.1-feet where 10-feet is required; permission to include five parking spaces where 10 are required; permission to allow parking back into the property’s right-of-way; and a setback for stairs of just a few inches. The parcel is located in the General Business-Multifamily zone, and abuts a residential home.
A hearing on the application will be held at the Nov. 5, 2025 planning board meeting, which is scheduled for 6 p.m. at the township municipal complex at 33 Washington Street on the mainland.
